Coker family plot at the North Rockhampton Cemetery is in the Church of England area Compartment 3, Section 3. There are eight burials; three each in graves 4, 5 and two in grave 6. Buried in grave 4 are: Arthur Coker 28/2/1945, Emily Ellen Coker 24/6/1970 and Estel Frances Maud Coker 16/1/1886.
Buried in grave 5 are: Arthur Coker 22/12/1925, Harry Coker 17/10/1924 and James Thomas Coker 4/8/1920. Buried in grave 6 are: Constance Ellen Coker 28/3/1884 and Mary Florence Coker 6/12/1902<hr>

QUESTION.
COKER V. COKER.
An interesting legal question has cropped up in connection with the suit instituted by Henry Coker, miner, Mount Morgan, against his wife Frances Jane Coker, nee Sugden, for a dissolution of the marriage on the ground of the adultery of the woman, who resides at Longreach. At the time the writ was issued the petitioner had no knowledge of the party with whom his wife had been associating, and on the 26th of July he made an application under order 16 of rule 23 of the Divorce and Matrimonial Rules of 1891 to His Honour Mr. Justice Power, in Chambers, that he should be excused from joining any co- defendant. Mr. F.B. Kavanagh (Messrs. Swanwick and Kavanagh) appeared in support of the application, and read an affidavit by Coker showing that he was married to the defendant at Calliope, near Gladstone, on the 29th of July, 1888 ; that he lived with her at Norton, near Calliope, and other places until about the 17th of March, 1893; that his wife then, without cause, left him and had lived apart from him ever since; that he had seen her only once since the 17th of March, 1893 - namely, about
a month later-when she came to his residence for her clothes that she had left there ; and that on or about the 14th of February last, at Longreach, she gave birth to a child. His Honour granted the application.
Subsequently it came to the knowledge of the petitioner, through the certificate of birth of the child and admissions by the defendant, who the father of the child was ; and rule 26 of the Divorce and Matrimonial Rules pro- viding that where the name of any alleged adulterer is unknown to a petitioner at the time of filing a petition, but afterwards becomes known to him, he must apply forth- with for leave to amend the petition by adding such person as a co-defendant, application had to be made to His Honour for leave to join the father of the child. The application came before His Honour on Monday last, and Mr. Kavanagh appeared in support of it. Mr. Kavanagh explained that though he made the application, he did it only to comply with the rule. He had no wish to join the co-defendant. In fact, he was in this posi- tion - it would be impossible for him to prove the adultery by the co-defendant, as the only
evidence he had was that contained in ad-
missions by the defendant and these would not be evidence against the co-defendant. His Honour adjourned the application until Wednesday, when he gave judgment. He said the opinion he had formed was that no good purpose could be served by joining the co-defendant. The defendant's admis- sions would not be evidence against, the co- defendant, and if the co-defendant were joined, it might result, if he (the co-defendant ) appeared, in the petitioner being unelected in costs. His Honour referred to the case of Jinkings v. Jinkings (1 P. and M. 330) and
said he would make no order.
Yesterday Mr. Kavanagh again appeared before His Honour and applied for directions as to the place, time, and mode of trial of the matter in accordance with order 29 of rule 17 of the Divorce and Matrimonial Rules. His Honour fixed the trial for 10 a.m. on Thurs- day next, at the Supreme Court, Rock- hampton, without a jury. Mr. Kavanagh made the further application that the evidence of Robert John M'Cullough, solicitor, Bar- caldine, as set forth in an affidavit filed that day, be taken at the trial by affidavit. The application was granted.
